On 24 July 2005 at 5h30 the Ministry of Fisheries and Marine Resources Patrol Vessel " Anna Kakurukaze Mungunda" spotted a Fishing Vessel "Namibia Star" which belongs to Namsov Fishing Enterprises (Pty) Ltd. The Captain was charged with the offence of catching marine resources in a prohibited area, a contravention of the Marine Resources Act No. 27 of 2000.

The Captain appeared in the Swakopmund Magistrate court. The case was postponed to 24 August 2005 for further investigations. The captain was granted bail of N$ 50 000 with the following conditions: - that the passport be handed in to the investigating officer; - all fish to be off-loaded before the vessel returns to sea; - Captain not restricted from the vessel.
